1. Introduction

Welcome to ArchStack™ ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the ArchStack course website, content, and services (collectively, the "Service") operated by Embedded Nature LLC.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Acceptance of Terms

By creating an account, subscribing to the course, or accessing any content, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and Embedded Nature LLC.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

3. Course Access and Subscription Terms

3.1 Subscription Plans

ArchStack offers subscription plans that provide access to course content, including:

• Lifetime Access: One-time payment for lifetime access to all course content
• Payment Plans: Monthly payment plans with ongoing access while payments are current

3.2 Access Rights

Upon successful payment and account creation, you will receive access to:

• All course modules, lessons, and labs
• Community access (Discord/Microsoft Teams)
• Course materials and resources
• Updates and new content added to the course

3.3 Account Responsibility

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account
• Ensuring your account information is accurate and up-to-date

4. Payments

4.1 Payment Processing

All payments are processed securely through Stripe, a third-party payment processor. By making a purchase, you agree to Stripe's Terms of Service and Privacy Policy.

We do not store your full payment card information. All payment data is handled by Stripe in compliance with PCI DSS standards.

4.2 Pricing

All prices are displayed in USD and are subject to change without notice. We reserve the right to modify pricing at any time, but price changes will not affect subscriptions already purchased.

4.3 Payment Plans

If you choose a payment plan, you agree to make all scheduled payments. Failure to make payments may result in suspension or termination of your access to the Service.

5. Refund Policy

5.1 Conditional Refund Window

We offer a 14-day refund window from the date of purchase, subject to the following conditions:

• Refunds are only available before accessing Stage 1 content. Once you have accessed Stage 1 course content, refunds are no longer available.
• This policy is in place to protect our intellectual property and prevent unauthorized distribution of course materials.
• You must explicitly acknowledge this refund policy during checkout.

5.2 Refund Process

To request a refund:

1. Contact us at [email protected] within 14 days of purchase
2. Provide your order number and account email
3. Confirm that you have not accessed Stage 1 content

Refunds will be processed within 5-10 business days to your original payment method.

5.3 No Refunds After Stage 1 Access

Once you have accessed Stage 1 content, all sales are final. No refunds will be provided after this point, regardless of circumstances.

6. User Accounts

You are responsible for:

• Providing accurate and complete information when creating your account
• Maintaining the security of your account credentials
• All activities that occur under your account
• Notifying us immediately of any security breach or unauthorized access

We use Better Auth for authentication, which is self-hosted on our infrastructure. Your account data is stored securely and handled in accordance with our Privacy Policy.

7. Intellectual Property

7.1 Course Content Ownership

All course content, including but not limited to text, graphics, videos, code examples, documentation, and course materials, is the exclusive property of Embedded Nature LLC and is protected by copyright, trademark, and other intellectual property laws.

7.2 License to Use

Upon purchase, you receive a limited, non-exclusive, non-transferable license to:

• Access and view course content for your personal educational use
• Use code examples and templates in your own projects
• Reference course materials for your own learning

7.3 Prohibited Uses

You may NOT:

• Copy, reproduce, distribute, or share course content with others
• Resell, sublicense, or transfer your access to another person
• Create derivative works based on course content for commercial purposes
• Record, screen capture, or download course videos
• Share your account credentials with others

7.4 User-Generated Content

If you submit content to our community forums, Discord, or other platforms:

• You retain ownership of your original content
• You grant us a license to use, display, and distribute your content within the Service
• You represent that your content does not infringe on any third-party rights

8. Prohibited Uses

You agree NOT to:

• Use the Service for any illegal or unauthorized purpose
• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Transmit viruses, malware, or harmful code
• Attempt to gain unauthorized access to the Service or other users' accounts
• Interfere with or disrupt the Service or servers
• Use automated systems to scrape or download content
• Share your account credentials or allow others to access your account
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to compete with or create competing products

9. Disclaimers

9.1 Trading Risk Disclosure

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• No Warranty: The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied.
• No Guarantee of Results: We do not guarantee that you will achieve any specific results, income, or profits from using the Service.
• Limitation of Damages: In no event shall Embedded Nature LLC be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or trading losses.
• Maximum Liability: Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
• Trading Losses: We are not responsible for any trading losses, investment decisions, or financial outcomes resulting from your use of the Service.

11. Termination

11.1 Termination by You

You may terminate your account at any time by contacting us at [email protected]. Termination does not entitle you to a refund unless you qualify under Section 5 (Refund Policy).

11.2 Termination by Us

We reserve the right to suspend or terminate your account immediately if you:

• Violate these Terms
• Engage in fraudulent or illegal activity
• Share your account credentials or course content
• Fail to make required payments (for payment plans)
• Engage in behavior that harms other users or the Service

11.3 Effect of Termination

Upon termination:

• Your access to the Service will be immediately revoked
• You must cease all use of course content
• We may delete your account and associated data
• Provisions that by their nature should survive termination will remain in effect

12. Dispute Resolution

12.1 Binding Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA), rather than in court.

12.2 Arbitration Process

• Arbitration will be conducted in Minnesota, United States
• The arbitrator's decision will be final and binding
• Arbitration will be conducted on an individual basis, not as a class action
• You waive your right to a jury trial

12.3 Class Action Waiver

You agree that any dispute will be resolved on an individual basis and waive your right to participate in a class action lawsuit or class-wide arbitration.

12.4 Exceptions

Notwithstanding the above, either party may seek injunctive relief in court to prevent irreparable harm or to enforce intellectual property rights.

13. Age Requirements

13.1 Service Age Requirement

ArchStack is intended for users 18 years or older. Users under 18 must have parental consent. By using ArchStack, you represent that you are at least 18 years old or have parental consent.

13.2 Trading Age Requirement

Trading (including paper trading) requires you to be 18+ and complete identity verification with Alpaca Markets or another broker. We do not provide trading services directly.

13.3 Age Verification

We reserve the right to verify your age and may request proof of age or parental consent. If we discover you are under 18 without parental consent, we will terminate your account immediately.

13.4 Consequences for Underage Users

If you are under 18 and use the Service without parental consent:

• Your account will be terminated
• You will not be entitled to a refund
• We may delete your account and associated data

14. Force Majeure

We shall not be liable for any failure or delay in performance under these Terms due to circumstances beyond our reasonable control, including but not limited to:

• Natural disasters
• War, terrorism, or civil unrest
• Pandemics or public health emergencies
• Internet or telecommunications failures
• Government actions or regulations
• Strikes or labor disputes
• Third-party service failures (hosting, payment processors, etc.)

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on this page
• Updating the "Last Updated" date
• Sending an email notification (for significant changes)

Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service and may terminate your account.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Minnesota, United States, without regard to its conflict of law provisions.

Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Minnesota, and you consent to the personal jurisdiction of such courts.

18. Severability
